Please read these Terms and Conditions ("Terms") carefully before using the FocusPocus mobile application (the "App") operated by 4 LOOP Wojciech Jachowicz ("us," "we," or "our").
Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all users who access or use the App. By accessing or using the App, you agree to be bound by these Terms.
1. License to Use
We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the FocusPocus App strictly in accordance with these Terms for your personal, non-commercial purposes.
2. In-App Purchases
The App includes optional content, such as animation packs ("In-App Purchases"), which can be purchased. These purchases are processed through the Apple App Store, from which you originally downloaded the application. All billing and transaction processes are handled by the Apple App Store and are governed by their terms and conditions.
All In-App Purchases are final and non-refundable, except as required by applicable law or the policies of the Apple App Store.
3. Intellectual Property
The App and its original content, including but not limited to the FocusPocus name, logo, design, and all animations (both free and premium), features, and functionality are and will remain the exclusive property of 4 LOOP Wojciech Jachowicz. The App is protected by copyright and other laws. Our trademarks may not be used in connection with any product or service without our prior written consent.
4. Prohibited Uses
You agree not to use the App:
- In any way that violates any applicable law or regulation.
- To reverse engineer, decompile, or disassemble the App.
- To copy, modify, or create derivative works of the App or its content.
5. Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
6. Disclaimer of Warranty
The App is provided to you "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. We provide no warranty that the App will meet your requirements, achieve any intended results, be compatible with any other software, or operate without interruption.
7. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, damages for personal injury, loss of profits, loss of data, or other intangible losses, resulting from your use of the App.
8. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by updating the "Effective Date" of these Terms and Conditions. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
